BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, January 22, 2025 BUILDING AND STANDARDS COMMISSION REGULAR MEETING MINUTES WEDNESDAY, JANUARY 22, 2025 The BUILDING AND STANDARDS COMMISSION convened in a REGULAR meeting on 22 January 2025, at the CITY OF AUSTIN PERMITTING AND DEVELOPMENT CENTER (PDC), 6310 WILHELMINA DELCO DRIVE, ROOM 1405, in Austin, Texas. CHAIR TIMOTHY STOSTAD called the BUILDING AND STANDARDS COMMISSION (BSC) Meeting to order at 6:46 p.m. Commissioners in Attendance: Chair Timothy Stostad, Vice Chair Blaine Campbell, Commissioners: Luis Osta Lugo, Michael Francis, Kurt Lockhart and Raisch Tomlanovich Commissioners in Attendance Remotely: Ex Officio Commissioner Chief Stephen Truesdell. PUBLIC COMMUNICATION: GENERAL No citizens signed up to speak during Public Communication. APPROVAL OF MINUTES 1. PUBLIC HEARINGS 2. Approve the minutes of the BUILDING AND STANDARDS COMMISSION SPECIAL CALLED MEETING on November 7, 2024. The minutes from the meeting of November 7, 2024 were approved on VICE CHAIR CAMPBELL’s motion, COMMISSIONER OSTA LUGO’s second, with no objections. Conduct a public hearing and consider case number CL 2024-090872; Property address: 1202 E 51st Street, also known as Ridgetop Apartments. VICE CHAIR CAMPBELL moved to close the public hearing, COMMISSIONER FRANCIS’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the commercial structures within 45 days, with a civil penalty of $1000 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, 1 BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, January 22, 2025 COMMISSIONER FRANCIS’s second. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER LOCKHART’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for demolition within 75 days, and on the 76th day, if compliance is not achieved, authorize the Code Official is to proceed with demolition, COMMISSIONER FRANCIS’ second. The motion carried on a 6-0 vote. COMMISSIONER SELIG and COMMISSIONER SOKOL were absent. Conduct a public hearing and consider case number CL 2024-136124; Property address: 3413 Southill Circle. VICE CHAIR CAMPBELL moved to close the public hearing, COMMISSIONER FRANCIS’s second, with no objections. COMMISSIONER FRANCIS moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER LOCKHART’S second. The motion carried on a 6-0 vote. COMMISSIONER SELIG and COMMISSIONER SOKOL were absent. Conduct a public hearing and consider case numbers CL 2024-139363; Property address: 709 Delmar Avenue. VICE CHAIR CAMPBELL moved to close the public hearing, COMMISSIONER FRANCIS’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact and conclusions of law and adopt City Staff’s recommendation for demolition, with the amendment that the compliance timeframe be changed from 45 to 60 days, and if compliance is not achieved, authorize the Code Official to proceed with demolition on the 61st day from the date the order is mailed. COMMISSONER TOMLANOVICH’s second. The motion carried on a 6-0 vote. COMMISSIONER SELIG and COMMISSIONER SOKOL were absent. Conduct a public hearing and consider a case number CL 2016-056078; Property address: 7913 Lee Hill Drive. Due to lack of time, this case was not heard. During FUTURE AGENDA ITEMS, this case was re-scheduled for hearing at the February 26, 2025 meeting. VICE CHAIR CAMPBELL moved to adopt the findings of fact, and conclusions of law and order that the civil penalties be reduced to $12,337.40 in each of the three cases, to total $37,012.20, if paid in full within 30 days from the date the order is mailed, and on the 31st day, if not paid in full, that the remaining portion of the original penalty be reinstated with interest, COMMISSIONER FRANCIS’s second. The motion carried on a 6-0 vote. COMMISSIONER SELIG and COMMISSIONER SOKOL were absent. Conduct a public hearing and consider an appeal regarding case numbers CL 2023-128097, CL 2023-114247, CL 2024-004525 and CL 2024-004523; Property address: 2301 Durwood Street, Buildings 1-4, also known as 2324 Wilson Street, also known as Lucero Apartment Homes. VICE CHAIR CAMPBELL moved to close the public hearing, COMMISSIONER OSTA LUGO’s second, with no objections. COMMISSIONER OSTA LUGO moved to adopt the findings of fact, and conclusions of law and recommended order with the amendment that that the total combined civil penalty be reduced to $666,049.16 if paid in full within 30 days from the date the order is mailed, and on the 31st day, if not paid in full, that the remaining portion of the original penalty be reinstated with interest. Not being seconded, the motion failed. VICE CHAIR CAMPBELL moved to adopt the findings of fact, and conclusions of law and order that the civil penalties be reduced to $60,000.00 if paid in full within 30 days from the date the order is mailed, and on the 31st day, if not paid in full, that the remaining portion of the original penalty be reinstated with interest, COMMISSIONER FRANCIS’s second. COMMISSONER TOMLANOVICH proposed a friendly amendment that the original total combined civil penalty be reduced to $100,000.00. The maker accepted the friendly amendment. The amendment failed on a 5-1 vote. COMMISSIONER FRANCIS voted nay. COMMISSIONER SELIG and COMMISSIONER SOKOL were absent. COMMISSIONER OSTA LUGO proposed a friendly amendment to the main motion that the amount of time allowed for payment before the original penalty amount is reinstated be changed from 30 to 60 days. This was accepted by the maker of the motion. The friendly amendment carried on a 6-0 vote. COMMISSIONER SELIG and COMMISSIONER SOKOL were absent. COMMISSONER LOCKHART proposed a friendly amendment on the pending motion as amended changing the penalty reduction amount from $60,000 to $90,000.00. The maker accepted the friendly amendment. The amendment carried on a 6- 0 vote. COMMISSIONER SELIG and COMMISSIONER SOKOL were absent. The motion as twice amended carried on a 6-0 vote. COMMISSIONER SELIG and COMMISSIONER SOKOL were absent. FUTURE AGENDA ITEMS The property located at 7913 Lee Hill Drive/ CL 2016-056078, will be heard at the February 26, 2025 meeting due to lack of time to hear the case. 3 BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, January 22, 2025 VICE CHAIR CAMPBELL’S motion to waive the rules and allow the BUILDING AND STANDARDS COMMISSION to meet after 10 p.m. for an additional 15 minutes to 10:15 p.m., COMMISSIONER OSTA LUGO’s second, was approved without objection. VICE CHAIR CAMPBELL’S motion to waive the rules and allow the BUILDING AND STANDARDS COMMISSION to meet after 10 p.m. for an additional 5 minutes, from 10:15 to 10:20 p.m., COMMISSIONER OSTA LUGO’s second, was approved without objection. CHAIR STOSTAD’S motion to waive the rules and extend the meeting for an additional 10 minutes from 10:20 p.m. to 10:30 p.m., COMMISSIONER FRANCIS’s second, carried without objection CHAIR STOSTAD adjourned the meeting at 10:30 p.m. without objection. The minutes were approved at the February 26, 2025 meeting on COMMISSIONER FRANCIS’ motion, COMMISSIONER LOCKHART second on a 7-0 vote. 4
