BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, September 25, 2024 BUILDING AND STANDARDS COMMISSION REGULAR MEETING MINUTES WEDNESDAY, September 25, 2024 The BUILDING AND STANDARDS COMMISSION convened in a REGULAR meeting on 25 September 2024, at the CITY OF AUSTIN PERMITTING AND DEVELOPMENT CENTER (PDC), 6310 WILHELMINA DELCO DRIVE, ROOM 1405, in Austin, Texas. CHAIR TIMOTHY STOSTAD called the BUILDING AND STANDARDS COMMISSION (BSC) Meeting to order at 6:54 p.m. Commissioners in Attendance: Chair Timothy Stostad, Vice Chair Blaine Campbell, Commissioners: Luis Osta Lugo, Edward Selig and Ex Officio Commissioner Chief Stephen Truesdell. Commissioners in Attendance Remotely: Commissioners: Michael Francis, Christopher Sokol. PUBLIC COMMUNICATION: GENERAL No one appeared before the Commission for Public Communication. APPROVAL OF MINUTES Approve the minutes of the BUILDING AND STANDARDS COMMISSION REGULAR MEETING on August 28, 2024. The minutes from the meeting of August 28, 2024 were approved on VICE CHAIR CAMPBELL’s motion, COMMISSIONER OSTA LUGO’s second, with no objections. COMMISSIONER SCHUGART was absent. PUBLIC HEARINGS 2. Conduct a public hearing and consider case number CL 2024-076044; Property address: 8301 W. State Highway 71. VICE CHAIR CAMPBELL moved to close the public hearing, COMMISSIONER SELIG’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER FRANCIS’ second. VICE CHAIR CAMPBELL moved to close the public hearing, COMMISSIONER SELIG’s second, with no objections. VICE CHAIR CAMPBELL moved in both cases to adopt the findings of fact and conclusions of law and adopt City Staff’s recommendation for repair with the modification of the compliance timeframe from 45 to 90 days, and if compliance is not achieved, with a civil penalty of $1,000 per week that will accrue until the repairs required by each of the Orders are complete. COMMISSONER OSTA LUGO’s second. The motion carried on a 6-0 vote. COMMISSIONER SCHUGART was absent. Conduct a public hearing and consider case number CL 2021-034963; Property address: 901 E. Cesar Chavez Street. VICE CHAIR CAMPBELL moved to close the public hearing, COMMISSIONER SELIG’s second, with no objections. COMMISSIONER SELIG’s second. The motion carried on a 6-0 vote. COMMISSIONER SCHUGART was absent. Conduct a public hearing and consider an appeal regarding case numbers CL 2023-040275 and CL 2023-038121; Property address: 1221 Algarita Avenue - Exterior and Building 14, Unit 277, also known as 1221 Algarita Avenue and also known as Cascade Apartments. COMMISSIONER SELIG moved the public hearing, VICE CHAIR to close CAMPBELL’s second, with no objections. COMMISSIONER OSTA LUGO moved to adopt the findings of fact, and conclusions of law and recommended order with the amendment that that the total combined civil penalty be reduced to $8,000.00 if paid in full within 30 days from the date the order is mailed, and on the 31st day, if not paid in full, that the remaining portion of the original penalty be reinstated with interest, VICE CHAIR CAMPBELL’s second. VICE CHAIR CAMPBELL’s proposed a friendly amendment to divide the proposed reduced civil penalty, reducing the $13,753.15 penalty to $5000.00 and reducing the $5,058.63 civil penalty to $3000.00, COMMISSIONER OSTA LUGO’s second. The amendment carried on a 6-0 vote. COMMISSIONER BENIGNO and COMMISSIONER SCHUGART were absent. The motion as amended carried on a 6-0 vote. COMMISSIONER SCHUGART was absent. Conduct a public hearing and consider case number CV 2024-027860 regarding an appeal of a Notice of Violation. Property address: 8888 Tallwood Drive. This item was pulled from the agenda at the request of City staff and was not heard. Conduct a public hearing and consider case number CV 2024-089556 regarding an appeal of a Notice of Violation. Property address: 1120 Denfield Street, Unit 2. The appeal was withdrawn by the appellant and the item was not heard. FUTURE AGENDA ITEMS There were no future agenda items. VICE CHAIR CAMPBELL’S motion to waive the rules and allow the BUILDING AND to meet after 10 p.m. for an additional 15 minutes, STANDARDS COMMISSION COMMISSIONER SCHUGART’s second, was approved without objection. CHAIR STOSTAD adjourned the meeting at 10:05 p.m. without objection. The minutes were approved at the November 7, 2024 special called meeting on COMMISSIONER OSTA LUGO’s motion, COMMISSIONER SELIG’S second on a 6-0 vote. 3
