BUILDING AND STANDARDS COMMISSION MEETING MINUTES Thursday, August 8, 2024 BUILDING AND STANDARDS COMMISSION SPECIAL-CALLED MEETING MINUTES THURSDAY, AUGUST 8, 2024 The BUILDING AND STANDARDS COMMISSION convened in a SPECIAL-CALLED meeting on 8 August 2024, at the CITY OF AUSTIN PERMITTING AND DEVELOPMENT CENTER (PDC), 6310 WILHELMINA DELCO DRIVE, ROOM 1405, in Austin, Texas. CHAIR TIMOTHY STOSTAD called the BUILDING AND STANDARDS COMMISSION (BSC) Meeting to order at 6:42 p.m. Commissioners in Attendance: Chair Timothy Stostad, Vice Chair Blaine Campbell, Commissioners: Michael Francis, Luis Osta Lugo, Logan Schugart, Edward Selig. Commissioners in Attendance Remotely: Commissioner Christopher Sokol. PUBLIC COMMUNICATION: GENERAL Joe Ford appeared before the commission for public communication to request a penalty relief hearing at a future date for the BSC order on 901 E Cesar Chavez (CL 2021-034963). Leslie Zuniga appeared before the commission for public communication to request a penalty relief hearing at a future date for the BSC orders on 1221 Algarita Avenue, Exterior and Unit 277 (CL 2023-040275 and CL 2023-038121). APPROVAL OF MINUTES 1. Approve the minutes of the BUILDING AND STANDARDS COMMISSION REGULAR MEETING on June 26, 2024. The minutes from the meeting of June 26, 2024 were approved on COMMISSIONER FRANCIS’ motion, COMMISSIONER SCHUGART’s second, with no objections. COMMISSIONER BENIGNO was absent. PUBLIC HEARINGS 2. COMMISSIONER SELIG moved to close the public hearing, COMMISSIONER SCHUGART’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and adopt staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER OSTA LUGO’s second. The motion passed on an 7-0 vote. COMMISSIONER BENIGNO was absent. Conduct a public hearing and consider case numbers CL 2024-058535; Property address: 3811 Grayson Lane. COMMISSIONER SELIG moved to close the public hearing, COMMISSIONER CAMPBELL’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation, with the modification of order for demolition to order for repair of the residential structure within 45 days, with a civil penalty of $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER SOKAL’s second. COMMISSIONER OSTA LUGO proposed a friendly amendment to change the compliance period from 45 to 90 days, with the $250 civil penalty beginning on the 91st day. VICE CHAIR CAMPBELL accepted the friendly amendment. The motion passed on an 6-1 vote. COMMISSIONER SCHUGART voted nay. COMMISSIONER BENIGNO was absent. Conduct a public hearing and consider case numbers CL 2024-076026; Property address: 8301 Los Ranchos Drive. COMMISSIONER SELIG moved to close the public hearing, COMMISSIONER SCHUGART’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, conclusions of law and adopt staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER SCHUGART’s second. The motion passed on an 7-0 vote. COMMISSIONER BENIGNO was absent. Conduct a public hearing and consider case number CL 2024-129313; Property address: 2901 Sweeney Lane. COMMISSIONER SELIG moved to close the public hearing, COMMISSIONER SCHUGART’s second, with no objections. COMMISSIONER SELIG moved to adopt the findings of fact, conclusions of law and adopt staff’s recommendation ordering that the owner provide to the Commission’s Coordinator a written engineering report as prepared by an engineer licensed by the Texas Board of Professional Engineers, that, through an on-site inspection, evaluates the current and long-term structural integrity of the subject building, ordering repair of the commercial structure within 45 days, with a civil penalty of $1000 per week beginning on the 46th day from the date the order is mailed and continuing until 2 6. 7. BUILDING AND STANDARDS COMMISSION MEETING MINUTES Thursday, August 8, 2024 compliance is achieved, and ordering the owner continue to secure the property by maintaining the temporary fence, as a means to alleviate its attractiveness as a public nuisance, until all repairs required by this Order are complete. COMMISSIONER OSTA LUGO’s second. The motion carried on a 6-1 vote. COMMISSIONER FRANCIS voted nay. COMMISSIONER BENIGNO was absent. Conduct a public hearing and consider case number CL 2024-049782; Property address: 1067 Springdale Road. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER SCHUGART’s second, with no objection. COMMISSIONER FRANCIS moved to adopt the findings of fact and conclusions of law and adopt City Staff’s recommendation to issue a new order that will supersede the prior repair order TRV 2022083955, issued on April 27, 2022, keeping the previously accrued penalty of $5257.14 in place with interest no longer continuing to accrue, and ordering the demolition of the residential structure and any accessory structures. The motion included the modification to City Staff’s recommendation to change the compliance period from 45 to 90 days, with the code official authorized to proceed with demolition on the 91st day. COMMISSIONER OSTA LUGO’s second. The motion passed on an 7-0 vote. COMMISSIONER BENIGNO was absent. Conduct a public hearing and consider a penalty relief request regarding case number CL 2022-031831; Property address: 1501 Reagan Hill Drive (aka 1500 Reagan Hill Drive, aka Val Dor II Apartments) COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER SELIG’s second, with no objections. VICE CHAIR CAMPBELL moved to adopt the findings of fact, and conclusions of law and order that the civil penalty be reduced to $15,000.00 if paid in full within 30 days from the date the order is mailed, and on the 31st day, if not paid in full, that the remaining portion of the original penalty be reinstated with interest. COMMISSIONER FRANCIS’ second. The motion carried on a 6-1 vote. COMMISSIONER SCHUGART voted nay. COMMISSIONER BENIGNO was absent. FUTURE AGENDA ITEMS Commissioner Osta Lugo and Vice Chair Campbell requested that 901 E Cesar Chavez (CL 2021- 034963) be brought back before the commission at the next available meeting for a penalty relief hearing. Commissioner Schugart, Commissioner Francis and Commissioner Selig requested that 1221 Algarita Avenue, Exterior and Unit 277 (CL 2023-040275 and CL 2023-038121) be brought back before the commission at the next available meeting for a penalty relief hearing.
