BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, June 26, 2024 BUILDING AND STANDARDS COMMISSION REGULAR MEETING MINUTES WEDNESDAY, June 26, 2024 The BUILDING AND STANDARDS COMMISSION convened in a REGULAR meeting on 26 June 2024, at the CITY OF AUSTIN PERMITTING AND DEVELOPMENT CENTER (PDC), 6310 WILHELMINA DELCO DRIVE, ROOM 1405, in Austin, Texas. CHAIR TIMOTHY STOSTAD called the BUILDING AND STANDARDS COMMISSION (BSC) Meeting to order at 6:35 p.m. Commissioners in Attendance: Chair Timothy Stostad, Vice Chair Blaine Campbell, Commissioners: Michael Francis, Luis Osta Lugo, Logan Schugart, Edward Selig. Commissioners in Attendance Remotely: Commissioner Christopher Sokol. PUBLIC COMMUNICATION: GENERAL No one appeared before the Commission for Public Communication. APPROVAL OF MINUTES Approve the minutes of the BUILDING AND STANDARDS COMMISSION REGULAR MEETING on April 24, 2024. The minutes from the meeting of April 24, 2024 were approved on COMMISSIONER SCHUGART’S motion, COMMISSIONER OSTA LUGO’s second, with no objections. COMMISSIONER SELIG was off dais. COMMISSIONER BENIGNO was absent. PUBLIC HEARINGS 2. Conduct a public hearing and consider an appeal regarding case number CL 2024-027512; Property address: 713 Vargas Road. COMMISSIONER OSTA LUGO moved to close the public hearing with no objections. COMMISSIONER CAMPBELL moved to adopt the findings of fact, conclusions of law and adopt staff’s recommendation to demolish the one-story portion of the residential structure with exception that timeframe be amended to 90 days while maintaining fencing to 1 1. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER SCHUGART’s and COMMISSIONER SELIG’S second, with no objections. COMMISSIONER SCHUGART moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the commercial structure within 45 days, with a civil penalty of $1000 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, VICE CHAIR CAMPBELL’S second. The motion carried on a 6-0 vote. COMMISSIONER OSTA LUGO was off dais. COMMISSIONER BENIGNO was absent. Case Number CL 2024-022470 regarding the property at 6307 Clubway Lane was pulled from the agenda at the request of city staff and was not heard. Conduct a public hearing and consider case number CL 2024-052138; Property address: 309 Camperdown Elm Drive. COMMISSIONER SELIG moved to close the public hearing, COMMISSIONER SCHUGART’s second, with no objections. COMMISSIONER SELIG moved to adopt the findings of fact and conclusions of law and adopt City Staff’s recommendation for repair within 45 days, and on the 46th day, if compliance is not achieved, assess a civil penalty of $250 the Order are complete. Conduct a public hearing and consider case number CL 2024-059693; Property address: 1011 E 16th Street. the repairs required by that will accrue until COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER SCHUGART’s second, with no objection. COMMISSIONER CAMPBELL moved to adopt the findings of fact and conclusions of law and adopt City Staff’s recommendation for demolition within 45 days, and on the 46th day, if compliance is not achieved, authorized the Code Official is to proceed with demolition, COMMISSIONER SCHUGART’s second. COMMISSIONER CAMPBELL moved to adopt the findings of fact, conclusions of law and adopt City Staff’s recommendation to uphold staff’s decision to suspend the rental registration at the Repeat Offender Program property, thereby denying the appeal, COMMISSIONER SELIG’s second. The motion carried on a 6-0 vote. COMMISSIONER OSTA LUGO was off dais. COMMISSIONER BENIGNO was absent. Conduct a public hearing and consider case numbers CL 2023-069307, CL 2023-069310, CL 2023-069312; CL 2023-069318 and CL 2023-069320 regarding penalty relief. Property address: 1137 Gunter Street, Exterior of Buildings 9, 14, 15, 16 and 17 (aka Lupine Terrace Apartments). COMMISSIONER SCHUGART moved to close the public hearing, COMMISSIONER SELIG’s second, with no objections. COMMISSIONER FRANCIS moved to adopt the findings of fact, conclusions of law and reduce the total civil penalty to $15,000, COMMISSIONER CAMPBELL’s second. COMMISSIONER FRANCIS amended his motion to include the requirement that the reduced penalty be paid within 30 days from the date the order is mailed or otherwise reverts to the previously assessed penalties in each of the 5 orders, COMMISSIONER CAMPBELL’s second. The motion carried on a 6-0 vote. COMMISSIONER OSTA LUGO was off dais. COMMISSIONER BENIGNO was absent. Conduct a public hearing and consider case numbers CL 2023-074854, CL 2023-074853, CL 2023-074858, CL 2023-074863 and CL 2023-074866 regarding penalty relief. Property address: 5800 Wellington Dr., Exterior of Building 3, 4, 7, 8 and 9 (aka Mueller Place Apartments). COMMISSIONER CAMPBELL moved to extend the meeting for 15 minutes, i.e., until 10:15 p.m., COMMISSIONER SELIG’s second. The motion carried without objection. COMMISSIONER CAMPBELL moved to close the public hearing, COMMISSIONER SCHUGART’s second, with no objections. COMMISSIONER CAMPBELL moved to adopt the findings of fact, conclusions of law and reduce the total civil penalty to $7,500 if paid within 30 days from the date the order is mailed or otherwise reverts to the previously assessed penalties in each of the 5 orders, COMMISSIONER SCHUGART’s second. The motion failed on a 5-1 vote. COMMISSIONER FRANCIS voted nay. COMMISSIONER OSTA LUGO was off dais. COMMISSIONER BENIGNO was absent. Presentation by Interim Division Manager Dedric Knox and Supervisor Kecia Lara regarding 2024 International Property Maintenance Code (IPMC) Proposed Amendments. 11. COMMISSIONER SCHUGART moved to approve recommended proposed amendments to the 2024 International Property Maintenance Code (IPMC), COMMISSIONER SELIG’s second. The motion passed on a 6-0 vote. COMMISSIONER OSTA LUGO was off dais. COMMISSIONER BENIGNO was absent. Discussion and planning regarding the Commission’s Annual Internal Review Report. This item was discussed. No vote was taken.
