BUILDING AND STANDARDS COMMISSION MEETING MINUTES Wednesday, April 24, 2024 BUILDING AND STANDARDS COMMISSION REGULAR MEETING MINUTES WEDNESDAY, April 24, 2024 The BUILDING AND STANDARDS COMMISSION convened in a REGULAR meeting on 24 April 2024, at the CITY OF AUSTIN PERMITTING AND DEVELOPMENT CENTER (PDC), 6310 WILHELMINA DELCO DRIVE, ROOM 1405, in Austin, Texas. CHAIR SADÉ OGUNBODE called the BUILDING AND STANDARDS COMMISSION (BSC) Meeting to order at 6:44 p.m. Commissioners in Attendance: Chair Sadé Ogunbode, Vice Chair Timothy Stostad Commissioners: Blaine Campbell, Michael Francis, Luis Osta Lugo, Logan Schugart, Edward Selig. Commissioners in Attendance Remotely: Assistant Fire Marshal Bret Carr attending on behalf of Ex Officio Commissioner Stephen Truesdell, Fire Marshal. PUBLIC COMMUNICATION: GENERAL No one appeared before the Commission for Public Communication. APPROVAL OF MINUTES 1. 2. ELECTION OF OFFICERS Approve the minutes of the BUILDING AND STANDARDS COMMISSION REGULAR MEETING on March 27, 2024. The minutes from the meeting of March 27, 2024 were approved on COMMISSIONER FRANCIS’ motion, COMMISSIONER SCHUGART’s second, with no objections. COMMISSIONER SELIG was off dias. COMMISSIONER BENIGNO was absent. Elect officers for the Building and Standards Commission. At this meeting the Commission is required to elect a Chair and Vice Chair who will serve a one year term beginning May 1, 2024 and running through April 30, 2025. COMMISSIONER OSTA LUGO nominated VICE CHAIR STOSTAD for the position of Chair, COMMISSIONER SCHUGART’s second. There were no objections to the nominations. COMMISSIONER BENIGNO was absent. COMMISSIONER OSTA LUGO nominated COMMISSIONER CAMPBELL for the position of Vice Chair. VICE CHAIR STOSTAD also nominated COMMISSIONER CAMPBELL for the position of Vice Chair. CHAIR OGUNBODE also nominated COMMISSIONER CAMPBELL for the position of Vice Chair. COMMISSIONER CAMPBELL accepted the nominations. There were no objections to the nominations. COMMISSIONER BENIGNO was absent. PUBLIC HEARINGS Conduct a public hearing and consider case number CL 2024-019744; Property address: 7310 Carver Avenue. COMMISSIONER CAMPBELL moved to close the public hearing, COMMISSIONER OSTA LUGO’s second. COMMISSIONER OSTA LUGO moved to adopt the findings of fact, conclusions of law and adopt staff’s recommendation with the amendment that the repair order be changed to an order for demolition within 90 days, and on the 91st day, if compliance is not achieved, authorized the Code Official is to proceed with demolition, second. The motion passed on a 7-0 vote. COMMISSIONER SELIG’s COMMISSIONER BENIGNO was absent. Case Number CL 2024-042327 regarding the property at 3102 White Rock Drive was pulled from the agenda at the request of city staff and was not heard. Conduct a public hearing and consider case number CL 2024-027597; Property address: 900 Old Koenig Lane. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER OSTA LUGO’s second, with no objections. COMMISSIONER CAMPBELL moved to adopt the findings of fact, conclusions of law and adopt City Staff’s recommendation for demolition with a modification to extend the compliance timeframe to 90 days, and on the 91st day, if compliance is not achieved, authorized the Code Official is to proceed with demolition. COMMISSIONER OSTA LUGO’s second. COMMISSIONER FRANCIS offered a friendly amendment to modify the demolition compliance timeframe to staff’s original recommendation of 45 days, and on the 46th day, if compliance is not achieved, authorized the Code Official to proceed with demolition. COMMISSIONER CAMPBELL accepted the friendly amendment, COMMISSIONER OSTA LUGO’s second. The motion carried on a 7-0 vote. COMMISSIONER BENIGNO was absent. Conduct a public hearing and consider case number CL 2024-032792 Property address: 1710 E M Franklin Avenue. The case was heard but then was withdrawn by city staff. 2 3. 4. 5. 6. 8. 9. 2. Case Number CL 2024-027512 regarding the property at 713 Vargas Road was pulled from the agenda at the request of city staff and was not heard. Conduct a public hearing and consider case number CL 2024-029656; Property address: 6900 Colony Park Drive. COMMISSIONER FRANCIS moved to close the public hearing, COMMISSIONER SCHUGART’s second, with no objections. COMMISSIONER OSTA LUGO moved to adopt the findings of fact, conclusions of law and adopt City staff’s recommendation for repair of the residential structure within 45 days, with a civil penalty of $250 per week beginning on the 46th day from the date the order is mailed and continuing until compliance is achieved, COMMISSIONER SCHUGART’s second. The motion passed on a 7-0 vote. COMMISSIONER BENIGNO was absent. Conduct a public hearing and consider an appeal regarding case number CV-2024-027973; Property address: 2108 Courtney Street. COMMISSIONER SCHUGART moved to close the public hearing, COMMISSIONER FRANCIS’s second, with no objections. COMMISSIONER SCHUGART moved to adopt the findings of fact, conclusions of law and adopt City Staff’s recommendation to affirm the notice of violation thereby denying the appeal, COMMISSIONER OSTA LUGO’s second. The motion passed on a 7-0 vote. COMMISSIONER BENIGNO was absent. FUTURE AGENDA ITEMS Two appeals are scheduled to be heard at the Wednesday, May 22, 2024 meeting of the Building and Standards Commission: 1. ROP rental registration appeal regarding 2301 Durwood Street, aka Lucero Apartments (CV 2023-033399, CV 2022-074079, CV 2023-106620 and CV 2022-073884) Penalty relief hearing regarding 1137 Gunter Street, buildings 9 & 14-17 (CL 2023- 069307; CL 2023-063910; CL 2023-069312; CL 2023-069318 and CL -2023-069320) CHAIR OGUNBODE adjourned the meeting at 8:57 p.m. without objection. The minutes were approved at the June 26, 2024 meeting on COMMISSIONER SCHUGART’s motion, COMMISSIONER OSTA-LUGO’S second on a 6-0 vote. COMMISSIONER SELIG was off dais. 3
