NOTE: 25-2-832 - PRIVATE SCHOOLS. This section applies to a public or private primary or secondary school. A site must be located on a street that has a paved width of at least 40 feet from the site to where it connects with another street that has a paved width of at least 40 feet. If more than one dwelling unit is located on the site, the dwelling units must comply with the requirements of this title that are applicable to residential uses. (1) (2) BOARD’S DECISION: The public hearing was closed by Chair Jeffery Bowen, Board Member Michael Von Ohlen’s motion to approve with conditions to prohibit access or curb cut on the Hillview side street and also that the school obtain No Parking signs established on the school property side of the street from property line marked 40.29 to 30.17 dimension line noted on Item04/04 Presentation sheet, Board member Corry L Archer-McClellan second on 11-0 votes; GRANTED WITH CONDITIONS TO PROHIBIT ACCESS OR CURB CUT ON THE HILLVIEW SIDE STREET AND ALSO THAT THE SCHOOL OBTAIN NO PARKING SIGNS ESTABLISHED ON THE SCHOOL PROPERTY SIDE OF THE STREET FROM PROPERTY LINE MARKED 40.29 TO 30.17 DIMENSION LINE NOTED ON ITEM04/04 PRESENTATION SHEET. FINDING: 1. The Zoning regulations applicable to the property do not allow for a reasonable use because: the property is prohibited from taking access to Hillview Road by a recorded plat note, and all legal access is dedicated exclusively to Exposition Boulevard. 2. (a) The hardship for which the variance is requested is unique to the property in that: the property is encumbered by a recorded plat note that prohibits vehicular access from Hillview Road and dedicates access exclusively to Exposition Boulevard, this restriction was not of the applicants making and is specific to this parcel, the hardship arises from the technical application of the street width standard to a road the property is legally forbidden to use. (b) The hardship is not general to the area in which the property is located because: the recorded plat note prohibiting Hillview Road access and dedicating access to Exposition Boulevard applies only to Lot 1 and Lot 2 of the Sanctuary Subdivision. 3. The variance will not alter the character of the area adjacent to the property, will not impair the use of adjacent conforming property, and will not impair the purpose of the regulations of the zoning district in which the property is located because: the purpose of Section 25-2-832(1) is to ensure a private school site has adequate street access to safely accommodate school- generated traffic, that purpose is fully satisfied as all access occurs exclusively via Exposition Boulevard which meets the required width standard, no access from Hillview Road is proposed or permitted, meaning no new traffic impacts on Hillview Road will result.
