Ashley Robinson, Project assistant Austin Energy Public Involvement | Real Estate Services 2500 Montopolis Drive Austin, TX 78741 (512) 322-6050 ITEM04/2 ITEM04/3Portion of the City of Austin Land Development Code applicant is seeking a variance from: ____________________________________________________________________________ Variance from Section 25-2-832 (Private Schools) to reduce the minimum roadway width ____________________________________________________________________________ (Hillview Lane) from 40 feet to 30 feet where it connects with another street that has a paved ____________________________________________________________________________ width of at least 40 feet (Exposition Blvd). ____________________________________________________________________________ Section 2: Variance Findings The Board must determine the existence of, sufficiency of, and weight of evidence supporting the findings described below. Therefore, you must complete each of the applicable Findings Statements as part of your application. Failure to do so may result in your application being rejected as incomplete. Please attach any additional supporting documents. NOTE: The Board cannot grant a variance that would provide the applicant with a special privilege not enjoyed by others similarly situated or potentially similarly situated. I contend that my entitlement to the requested variance is based on the following findings: Reasonable Use The zoning regulations applicable to the property do not allow for a reasonable use because: ____________________________________________________________________________ The Property is prohibited from taking access to Hillview Rd by a recorded plat note, and all ____________________________________________________________________________ legal access is dedicated exclusively to Exposition Blvd, which meets the 40-foot paved width ____________________________________________________________________________ standard of Sec. 25-2-832(1). Without a variance, the school cannot be authorized by CUP ____________________________________________________________________________ solely due to a technical street-width deficiency on a road the Property cannot legally use, even though its actual access street fully satisfies the regulation's intent. ____________________________________________________________________________ ____________________________________________________________________________ ____________________________________________________________________________ Hardship a) The hardship for which the variance is requested is unique to the property in that: ____________________________________________________________________________ The Property is encumbered by a recorded plat note that prohibits vehicular access from ____________________________________________________________________________ Hillview Rd and dedicates access exclusively to Exposition Blvd. This restriction was not of the ____________________________________________________________________________ Applicant's making and is specific to this parcel. The hardship arises from the technical ____________________________________________________________________________ application of the street-width standard to a road the Property is legally forbidden to use. ____________________________________________________________________________ b) The hardship is not general to the area in which the property is located because: ____________________________________________________________________________ The recorded plat note prohibiting Hillview Road access and dedicating access to Exposition Boulevard applies only to Lot 1 & 2 of The Sanctuary Subdivision. No other properties in the ____________________________________________________________________________ vicinity are subject to this same combination of a recorded access prohibition and a ____________________________________________________________________________ plat-dedicated access right to a separate, compliant street. This condition is unique to this ____________________________________________________________________________ parcel and is not shared generally throughout the neighborhood. ____________________________________________________________________________ City of Austin | Board of Adjustment General/Parking Variance Application (cid:21)(cid:18)(cid:28)(cid:18)(cid:21)(cid:21) | Page 5 of 8 ITEM04/4Area Character The variance will not alter the character of the area adjacent to the property, will not impair the use of adjacent conforming property, and will not impair the purpose of the regulations of the zoning district in which the property is located because: ____________________________________________________________________________ The purpose of Sec. 25-2-832(1) is to ensure a private school site has adequate street access ____________________________________________________________________________ to safely accommodate school-generated traffic. That purpose is fully satisfied here, as all ____________________________________________________________________________ access occurs exclusively via Exposition Blvd, which meets the required width standard. No ____________________________________________________________________________ access from Hillview Rd is proposed or permitted, meaning no new traffic impacts on Hillview ____________________________________________________________________________ Rd will result. ____________________________________________________________________________ Parking (additional criteria for parking variances only) Request for a parking variance requires the Board to make additional findings. The Board may grant a variance to a regulation prescribed in the City of Austin Land Development Code Chapter 25-6, Appendix A with respect to the number of off-street parking spaces or loading facilities required if it makes findings of fact that the following additional circumstances also apply: 1. Neither present nor anticipated future traffic volumes generated by the use of the site or the uses of sites in the vicinity reasonably require strict or literal interpretation and enforcement of the specific regulation because: ____________________________________________________________________________ N/A ____________________________________________________________________________ ____________________________________________________________________________ ____________________________________________________________________________ 2. The granting of this variance will not result in the parking or loading of vehicles on public streets in such a manner as to interfere with the free flow of traffic of the streets because: ____________________________________________________________________________ N/A ____________________________________________________________________________ ____________________________________________________________________________ ____________________________________________________________________________ 3. The granting of this variance will not create a safety hazard or any other condition inconsistent with the objectives of this Ordinance because: ____________________________________________________________________________ N/A ____________________________________________________________________________ ____________________________________________________________________________ ____________________________________________________________________________ 4. The variance will run with the use or uses to which it pertains and shall not run with the site because: ____________________________________________________________________________ N/A ____________________________________________________________________________ ____________________________________________________________________________ ____________________________________________________________________________ City of Austin | Board of Adjustment General/Parking Variance Application (cid:21)(cid:18)(cid:28)(cid:18)(cid:21)(cid:21) | Page 6 of 8 ITEM04/5ITEM04/6Additional Space (continued) _______________________________________________________________________________ The variance is justified because the hardship is unique to this parcel, arises from a recorded plat _______________________________________________________________________________ note not of the Applicant's making, and is technical in nature. The Property's dedicated access via _______________________________________________________________________________ Exposition Blvd already satisfies the purpose of Sec. 25-2-832(1), and granting the variance will not _______________________________________________________________________________ affect area character or impact adjacent properties. The Property has operated as a private school _______________________________________________________________________________ for over 20 years, and the Applicant is currently seeking a Conditional Use Permit to bring that _______________________________________________________________________________ long-standing use into full compliance with the Land Development Code, which cannot be achieved _______________________________________________________________________________ without the variance. _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ _______________________________________________________________________________ City of Austin | Board of Adjustment General/Parking Variance Application (cid:21)(cid:18)(cid:28)(cid:18)(cid:21)(cid:21) | Page 8 of 8 ITEM04/7ITEM04/8ITEM04/9ITEM04/10
