In order to grant your request for a variance, the Board must first make one or more of the findings described under 1, 2, and 3 below; the Board must then make the finding described in item 4 below. If the Board cannot make the required findings, it cannot approve a sign variance. Therefore, you must complete each of the applicable Findings Statements as part of your application. I contend that my entitlement to the requested variance is based on the following findings: 1. The variance is necessary because strict enforcement of the Article prohibits any reasonable opportunity to provide adequate signs on the site, considering the unique features of the site such as dimensions, landscaping, or topography, because: Pursuant to Section 25-2-594(C)(1) the maximum front yard setback for property zoned CBD is 10 feet which prohibits a freestanding sign along the front of the building since it cannot meet the required I2-foot setback from the street right-of-way. The office bu1ld1ng entrance along \/Vest 6th Street is located only 3-feet and 9-inches from the property line/street right-of-way. (CONT on last page) -OR- 2. The granting of this variance will not have a substantially adverse impact upon neighboring properties, because: The sign will be located near the office building entrance and oriented towards West 6th Street. Neighboring properties include a 23-story office building to the north, The Belmont to the east which Is an outdoor7indoor event venue and cocktail bar, a I 0-story office bu1ld1ng to the south, a public parking lot to the west, and a GO-story office and residential tower to the northwest. The granting of this variance will not have a substantially adverse impact upon neighboring properties, because (CONT): The only surrounding property that would be able to see the proposed freestanding sign is the 23- story office building to the north which is primarily occupied during daytime hours and would therefore be minimally impacted by the proposed sign.
