I have recently built a retaining wall with a maximum height of 9’6” inches to stabilize a sloped portion of my yard and prevent erosion. My intention is to install a 6-foot privacy fence on top of this wall for safety and privacy. When I began the project, I was unaware that placing a fence on a retaining wall could trigger the need for a variance due to overall height measured from the lower grade. Once I realized the total combined height — approximately 9’6” as viewed from the lower side — exceeded city limits, I halted construction and am now seeking to comply with the proper zoning process through this variance request. This situation presents a unique hardship caused by the natural slope of my property. The retaining wall was a necessary solution to maintain soil stability, and the planned fence is a standard privacy barrier. However, due to the elevation change, what would otherwise be a compliant 6-foot fence becomes non-compliant from the lower side. Without approval of this variance, I would be unable to complete a fence that provides both privacy and security for my home — which would not be an issue if my lot were level. I respectfully ask for your consideration of this variance request, so I may finish a necessary and appropriate improvement to my property. I am currently enrolled in the City of Austin’s Customer Assistance Program (CAP) and have attached a recent utility bill to support my request for a fee waiver .
