One year into the project, November of 2023, the City of Austin (COA) voted to remove minimum parking requirements (C20-2023-010). As a result, the 200sf attached garage exemption in Subchapter F was removed. Subsequently, making the proposed home 200sf over the allowable 40% FAR. The exemption, however, was still shown on COA new construction applications well into 2024, causing confusion on its implementation. As of today, the exemptions are still listed on page 3 of the City of Austin New Construction application still causing major confusion with owners and designers. These new code regulations as if applies to the removal of parking requirements need to be further explained in detail on these applications. HARDSHIP As a result of the code change, the owners were left with noncompliant plans one year into development. The owners had paid a year of design, engineering and consultants fees. It is extreme to have to redesign and lose any more time on a home that would have been approved at any time in the last 20 years in the McMansion area. In no way could the design team foresee such a significant change in code so far into the design of the project. Once the removal of the exemption was confirmed by city staff in summer of 2024, the design team has been looking at ways to resolve this issue and the project has been stalled. COA REVIEW HISTORY Five months into design and development of the project, two Preliminary Plan Reviews (PPR) were held with COA residential review in April and May of 2023, this review costs $550. Building designers Matt Garcia and Nicole Marshall were on the call. COA staff, Alyssa Mayfield was on COA review. The plans were reviewed for compliance regarding basement exemption, max building height interpretations, and general plan compliance. These plans were developed in compliance with the garage exemption in place. Historically, a PPR starts the permitting process and if available, reviewed ITEM04/6by the same review staff upon submittal. The owners and design team request that the 200sf attached garage exemption be honored. These plans and hardship were shared and discussed with the West Austin Neighborhood Group (WANG) at a monthly session on December 10, 2024. Two members of the board, Holly Reed and Blake Tollett, are also in support of this variance request. In addition, and to note history of this project, a previous variance (C15-2024-0009) for a front facing garage was approved March of 2024. We formally request the board to approve an increase of 1.3% of FAR from the standard 40% to an increase of 41.3% in order to have the current plans approved once we submit for formal review.
