Date: Subject: ARTS COMMISSION RECOMMENDATION 20210816.5.b.i-ii August 19, 2021 Arts Commission Recommendations regarding FY 22 Budget Items relating to funding for the Arts and expenditure of American Rescue Plan Funds (ARPA) for relief programs for the arts community Recommendations The Arts Commission recommends the following: 1. The use of a one-time $500,000 infusion from reserves (transfer in from Development Services Department) to increase the funding for the Austin Arts and Culture Non-profit Relief Grant in order to serve an additional 25 grant applicants. 2. The use of $420,000 of the $6 Million in ARPA funds allocated by Council to the Arts in order to fund an additional 21 eligible applications in the Austin Arts and Culture Non-Profit Relief Grant 3. Support of the Economic Development Department staff recommendation to adopt the proposed FY22 budget as presented in the City Manager's budget proposal, specifically to maintain the hybrid option reflected in Staff’s proposal to allocate a portion of projected HOT revenue for Cultural Contracts, continue the process of transitioning to using actuals versus projections, monitor HOT revenue, and come back in October to present a mid-year budget amendment if FY21 CYE comes in higher than projected. 4. Prioritize ARPA funds allocated to the Arts for emergency relief to the arts community, get emergency funding out the door as fast as possible, and not use ARPA to back fill cultural contract funding. Description of Recommendation to Council This recommendation is in response to a request from Council, made as part of Council budget deliberation and action session on Thursday, August 12, for input on matters regarding funding for the arts through both the 2022 City Budget and the American Rescue Plan Funds. This year it will be a 12‐month, exterior exhibition to connect tourists and convention delegates to Austin culture through public art. The Economic Development Department is considering multiple ways to deliver on this promise. Across its three Divisions that facilitate Hotel Occupancy Tax- funded programs, staff and Commission members have engaged in robust conversations informed by deep community engagement and feedback, leading to new and ongoing changes in their contracting and public service processes. These shifts will take into account the severe financial impacts that Austin’s creative sectors have experienced due to COVID-19, especially for Black, Indigenous, and Person of Color-led (BIPOC) arts organizations, coupled with the compounding effects of systemic racism. The City continues to respond to the realities of budget shortfalls due to event restrictions over the past 18 months. Changes in historical funding patterns are top of mind for everyone in the arts, heritage, and music sectors, and surely anxieties are heightened during this period of uncertainty. M E M O R A N D U M TO: Mayor and Council FROM: Sylnovia Holt Rabb, Acting Director Economic Development Department DATE: April 14, 2021 SUBJECT: Update on Cultural Trust and Creative Space Bond On behalf of the team supporting organizational development and execution of priority projects, this memo serves as an update with you on the progress of the Cultural Trust and the determination of support for the execution of work for the Creative and Cultural Facilities Bond under the auspices of Austin Economic Development Corporation (AEDC). As you are aware, Mayor and Council provided direction to align the development of AEDC with the intent and creation of an “Austin Cultural Trust” through Resolutions 20160303-019, 20170216-040, 20170302-034, 20180215-082 and 20190808-072. Council further directed the City Manager to expedite a review of existing entities and resources that could be centralized to support the timely execution of recovery efforts that could secure or retain creative culture and community benefits in Resolutions 20200521-095 and 20200521-096. AEDC was officially created by Mayor and Council through Resolution 20201001-055 on October 1, 2020. Since that time, staff and consultants have organized a significant amount of research and work to refine the scope of the trust while working with legal teams to determine viability of roles for the organization to support the use of the $12 million Creative and Cultural Facilities Bond. Council also allocated $2.4 million for the Iconic Venue Fund as established in 20201203-046 to create leasing structures to acquire and permanently preserve creative and music venues that promote tourism, support equity, and represent Austin’s brand and history. Contracting with the AEDC The City and AEDC are developing an interlocal agreement to frame the partnership between both agencies and to identify land or buildings to be acquired or land on which buildings would be constructed by the AEDC on behalf of the City with these bond proceeds. EDD staff is consulting with the City Attorney and the City’s outside bond counsel to ensure use and operation of the facilities are within the legal framework for these funds. The interlocal agreement will be placed on a future Council agenda for consideration at the time that the agreement has been agreed upon by City staff and AEDC.
