All speakers must register in advance (Day before the scheduled meeting, May 3, 2020 by Noon). All public comment will occur at the beginning of the meeting. To speak remotely at the May 4, 2020 Austin Integrated Water Resource Planning Community Task Force Meeting, residents must: •Call or email the board liaison at 512-972-0194 or marisa.flores@austintexas.gov no later than noon, (the day before the meeting). CITIZEN COMMUNICATION: GENERAL David Foster of Clean Water Action spoke about the Land Development Code as it relates to Water Forward Ordinances. 3. APPROVAL OF MEETING MINUTES The meeting minutes from the January 7, 2020 Austin Integrated Water Resource Planning Community Task Force regular meeting were approved with amendments on Member Mace’s motion and Member Richard’s second for a final 6-0-0-5 vote. 4. STAFF BRIEFINGS, PRESENTATIONS, AND/OR REPORTS a. A staff update on Water Forward implementation progress and outlook was provided by Marisa Flores Gonzalez, Austin Water. This was followed by Task Force discussion and input. b. A staff presentation on the Water Forward Fiscal Year 2019 Annual Report and Metrics was provided by Marisa Flores Gonzalez, Austin Water. This was followed by Task Force discussion and input. 5. ADJOURN Vice Chair Walker adjourned the meeting at approximately 5:24 pm. 5/4AIWRPCTF6 N O I T A T N E S E R P 5/4AIWRPCTF7 5/5/2020 1 5/4AIWRPCTF8 Water Forward Implementation Progress and Outlook 2 5/4AIWRPCTF9 Water Supply Update 3 5/4AIWRPCTF10 Water Supply Update 4 5/4AIWRPCTF11 Water Forward Implementation Progress Conservation • The Advanced Metering Infrastructure implementation RFQ received Council approval • Staff is participating in the Land Development Code Revision process • Staff has developed a draft Onsite Reuse Regulatory Framework which is being reviewed Reuse internally • Staff is continuing work on the Centralized Reclaimed Master Plan update Protecting our Core Supplies Building Drought Resiliency • The Region K Initially Prepared Plan is in the public comment period • The Aquifer Storage and Recovery pilot and program management consultant procurement process is underway Community Engagement • AW presented at the virtual Center for Watershed Protection's 2020 National Watershed & Stormwater Conference on April 14th • AW is participating in the update to Austin’s Community Climate Plan 5 5/4AIWRPCTF12 Water Forward Ordinance Update 6 5/4AIWRPCTF13 Water Forward Ordinance Update Land Development Code Revision Process • On March 18, 2020 a Travis County District Court judge ruled that the City did not follow the correct process for the LDC Revision and voided Council’s first and second reading votes on the draft code. • However, the judge’s decision leaves open several potential options for proceeding with a LDC Revision. • So, while the Law Department will appeal the judge’s decision, the LDC Team will work to identify and analyze multiple options for Council to consider. 7 5/4AIWRPCTF14 Water Forward Ordinance Update AW Next Steps on the LDC Revision • At this time, AW believes the best course of action will be to keep the Water Forward code changes in the Land Development Code • Some minor code changes may be required to align the effective dates proposed in the code language with the new LDC Revision adoption schedule 8 5/4AIWRPCTF15 Water Forward Ordinance Update 9 5/4AIWRPCTF16 Water Forward Ordinance Update Additional Code and Incentive Activities • Staff is working to develop onsite regulatory program rules, which will require stakeholder input and Council approval of a new ordinance • Staff is also working to develop a suite of alternative water incentives, which will require stakeholder input and some components may require Council approval • Staff has also proposed making some changes to the Conservation Code (6-4), which will require stakeholder input and may require Council approval 10 5/4AIWRPCTF17 Water Forward Ordinance Update Onsite Water Reuse System (OWRS) Program and Incentive 23-9D-1050 Onsite Water Reuse System Rules and Incentive Program (A) An onsite water reuse system is required for a large development project for which a site plan application is submitted under Division 23-6B-2 (Site Plan Review ) on or after December 1, 2023. (B) By December 1, 2020, the director shall: (1) Adopt rules to implement, administer, and enforce this article, including rules to regulate the treatment, monitoring, and reporting requirements for onsite water reuse systems; and (2) Develop an incentive program for onsite water reuse systems 11 5/4AIWRPCTF18 Water Forward Ordinance Update Rules/Ordinance Adoption Through Council Action 1 Draft an Ordinance and an Economic Impact Statement • Council committees may hold a hearing and vote on an ordinance, but the vote is only advisory to the full council • Vetting the ordinance through internal and external stakeholders is highly recommended to avoid contentious public hearings Pass Ordinances Following Reading Procedures set forth in Section 2-5 of City Code 2 • 3 Rules are Codified into a Chapter of City Code Involves a public hearing/Council session Code • Title 25. Water Wells These rules pertain to privately-owned or managed infrastructure that is regulated by utilities 5/4AIWRPCTF20 Water Forward Ordinance Update Chapter 25 (Land Development) Chapter 15 (Utility Regulations) Chapter 6 (Conservation) • Mandatory water balance submittal • Expanded reclaimed water connections & use • OWRS rules and mandate • Rules to implement, administer, and enforce the regulation, treatment, monitoring, and reporting requirements for OWRS • New grant for OWRS • Addition of administrative penalties for cooling tower registration and efficiency • Revisions to 6-4 LDC Process in Chapter 25 of City Code OWRS Ordinance in Chapter 15 of City Code & Incentive Program Administrative Changes to CII Requirements in Chapter 6-4 • New alternate water system rebates • Updates to current rainwater harvesting rebates Administrative Changes to Alternative Water Incentives 14 5/4AIWRPCTF21 Water Forward Ordinances The Plan with adjustments • Target is to have two stakeholder events possibly late Summer or early Fall 2020 • Event # 1 – stakeholder workshop (to be held remotely) to introduce the onsite regulatory program rules, suite of alternative water incentives, and proposed 6-4 code changes • Event # 2 – public open house (to be held remotely) to present the new and modified incentives in more detail and receive stakeholder feedback onsite regulatory program rules • Staff is working to review draft onsite regulatory program rules, coordinate with other City departments as necessary, plan remote stakeholder engagement alternatives, and develop materials for outreach and advertising 15 5/4AIWRPCTF22 Water Forward Ordinances Possible Future Ordinance Approval Process with adjustments • Below are preliminary targets for action related to the onsite regulatory program rules, alternative water incentives, and other code changes as necessary • Fall 2020 - Water Forward Task Force • Late 2020 - W/WW Commission, Resource Management Commission • Late 2020 to early 2021 – City Council 16 5/4AIWRPCTF23 Water Forward Ordinances AW Activities in the Meantime • Draft regulatory framework timeline and engagement process • Finalizing water balance application calculator and documents • Advertising and educational materials for code changes • Working on signage, displays and public engagement for the PDC pilot • The pilot reuse system is currently scheduled for start-up/commissioning in reuse system July 17 5/4AIWRPCTF24 Questions and Discussion 18 5/4AIWRPCTF25 Aquifer Storage and Recovery Update 19 5/4AIWRPCTF26 ASR Implementation • Major tasks will include • Research and pilot site selection, design, construction, and testing of pilot ASR • Full scale facility design, construction, and testing • Recommended in plan as a Carrizo-Wilcox ASR but plan to study additional potential locations • Target is to have 60,000 acre-feet per year of supply available by 2040 5/4AIWRPCTF27 Update on ASR Implementation Progress • FY 2020-2023 Identify where to pilot • FY 2024-2027 Design, construct, test ASR pilot, and develop recommendations for full-scale ASR • FY 2028-2029 Preliminary engineering for full-scale ASR • FY 2029-2030 Design for full-scale ASR • FY 2031-2035 Construction of full-scale ASR 21 5/4AIWRPCTF28 Update on ASR Implementation Progress • Currently in the process of procuring professional services for ASR implementation • In the no-contact phase of the RFQ process • The team procured through this RFQ will assist with: • Identifying site(s) for ASR piloting • Construction and operation of ASR pilot project(s) project • Recommendations for a full-scale ASR • Owner’s representation throughout construction of a full-scale ASR project 22 5/4AIWRPCTF29 ASR Next Steps • The procurement process has been delayed slightly due to COVID-19 complications • Currently working to have a consultant team on board by Fall 2020 • The next ASR technical advisory group meeting will likely be held remotely 23 5/4AIWRPCTF30 Questions and Discussion 24 5/4AIWRPCTF31 Thank you 3/3/2020 5/4AIWRPCTF32
