DISCUSSION AND ACTION ITEMS 5. Review actions of City Council at the December 1, 2022 and December 8, 2022 meetings.  Authorize negotiation and execution of an amendment to the legal services agreement with Winstead PC for representation related to the City of Austin v. LoneStar Airport Holdings, LLC and Texas Capital Bank in the condemnation proceeding in Probate Court No. 1 and the LoneStar Airport 28. Holdings, LLC v. the City of Austin, Texas federal lawsuit in the Western District of Texas, Austin Division, in the amount of $1,500,000, for a total contract amount not to exceed $3,097,000. Discussion regarding Connecting Passenger Impacts to AUS Operations and Revenues presented by Ghizlane Badawi, Chief Operations Officer and Mookie Patel, Chief Business and Finance Officer. 7. DISCUSSION AND ACTION ITEMS Review actions of City Council at the October 27, 2022 meeting. • Approve a resolution finding the use of the Construction Manager at Risk method of contracting, as authorized by Subchapter F, Chapter 2269 of the Texas Government Code, is the project delivery method that provides the best value to the City for the Barbara Jordan Terminal Optimization – Phase 2 project. Review of Commission recommendations and actions to discuss with appointing City Council Member. 6 1) Exceptional financial performance during FY 2022, revenues exceeded budget by $85mm, espouses only by $1.1mm 2) Existing debt is at a fixed interest rate. Don’t expect next raise until 2024. 3) 94 direct destinations from ABIA (including 17 international). 4) 20 months until initial baggage system improvement online. 5) 96% of surveyed respondents in 3Q22 rated ABIA as good to excellent. 6) Chair E. Sepulveda considers a 2% ACDBE goal a failure, and that it should be higher. Commissioner Hood expressed concern about digital billboards being erected along airport roadways. 7) Commission unable to be briefed on root cause of Barbara Jordan Terminal power failure on Sept 7, 2022. Austin Energy says information restricted due to critical infrastructure. Passenger enplanements totaled 996,719 in October 2022, an increase of 28.1% or 218,412 passengers compared to October 2019 (see below chart). Average daily departures have increased from 200 in October 2019 to 261 in October 2022, an increase of 61 daily departures or 30.5%. Landing weights totaled 1,179 million pounds in October 2022 representing an increase of 21% compared to October 2021. Cargo volume totaled 13,443 tons in October 2022 representing an increase of 2.1% compared to October 2021. Monthly operating revenues increased 23.2% or $4.5M compared to October 2021. Totaling $24M, October 2022 operating revenues reflect the impact of the strong passenger traffic in the month due to special events including Austin City Limits Music Festival and the US Grand Prix Formula 1 race. October 2022 operating revenue is composed of 43% airline revenue, 56% non-airline revenue, and 1% interest income. Airport operating expenses totaled $7.9M for the month, a decline of 10% or $0.9M compared to October 2021. The operating expenses in October 2021 were elevated because three pay periods occurred in the month. When adjusted to remove the additional pay period, October 2022 operating expenses increased 19.2% compared to October 2021. The increased operating expenses are the result of higher personnel costs resulting from the 4% across the board pay increase and increase in the living wage to $20 per hour, higher temporary employee and overtime expenses in response to higher passenger traffic, and increased contractual costs including parking services and consulting contracts. As a result of the strong operating performance, AUS reported a $10.2M surplus (before federal relief funding) in October 2022 compared to a surplus of $5.7M in October 2021. As presented in Table #2, FY2023 revenues exceed budgeted revenues by 22% or $4.3M. The increased revenues are the result of passenger traffic in the month that outperformed budgeted traffic forecast. Airport operating expenses are 16.1% or $1.5M below budgeted expenses due primarily to higher than budgeted personnel vacancy rates. Before federal relief funding application, AUS reports net income of $10.2M, which exceeds the seasonalized budget estimate by $5.9M.
