Downtown Austin Community Court Jurisdiction Recommended City Code Amendment of Section 2-10-32 – Offenses Adjudicated Proposition B – May 2021 On May 1, 2021, Austin voters approved Proposition B, making it a criminal offense (Class C misdemeanor punishable by a fine) for anyone to sit, lie down, or camp in public areas and prohibiting solicitation of money or other things of value at specific hours and locations. The above law can be found in City of Austin Code, Sections 9-4-11 (Camping), 9-4-13 (Solicitation Prohibited), 9-4-14 (Sitting or Lying down on Public Sidewalks or Sleeping Outdoors in the Downtown Austin Community Court Area Prohibited). On Sept. 1, HB 1925 took effect creating a statewide camping prohibition that is largely compatible with Austin City Code. It is Tex. Pen. Code §48.05 Prohibited Camping (Statewide). Tex. Penal Code 48.05 - Excerpts  “A person commits an offense if the person intentionally or knowingly camps in a public place without the effective consent of the officer or agency having the legal duty or authority to manage the public place.”  An offense under this section is a Class C misdemeanor.  This section does not preempt an ordinance adopted by a political subdivision, like the City of Austin, relating to prohibiting camping in a public place or affect the authority of a political subdivision to adopt or enforce an ordinance relating to prohibiting camping in a public place if the ordinance is compatible with and equal to or more stringent than the offense prescribed by this section. Tex. Penal Code 48.05 - Excerpts  Before or at the time a peace officer issues a citation to a person, the peace officer must make a reasonable effort to: (1) advise the person of an alternative place to lawfully camp; and (2) contact, if reasonable and appropriate, an appropriate official of the political subdivision in which the public place is located, or an appropriate nonprofit organization operating within that political subdivision, and request the official or organization to provide the person with: … (B) any other services that would reduce the likelihood of the person continuing to camp in the public place.  If the person is arrested or detained solely for an offense under this section, a peace officer enforcing this section shall ensure that all of the person's personal property not designated as contraband under other law is preserved by: (1) permitting the person …

Project Scope • Funded jointly by the Downtown Austin Alliance (DAA) and Downtown Austin Community Court (DACC) • Provide a direct handoff for homeless individuals identified by HOST/DACC in need of housing focused, community based, behavioral healthcare who otherwise would be waitlisted • Primary services include intensive community-based case management/rehabilitation services and access to psychiatric services. • Leverage resources available at the 3000 Oak Springs Clinic including primary care services, housing navigation, benefits assistance, and supported employment. • Weekly meetings with HOST/DACC to identify and staff referrals as well as any ongoing needs of participants 4 Staffing and Capacity • 5 FTE Community Based Rehabilitation Specialists • • Team will report to existing Program Manager at .25 FTE Prescriber 3000 Oak Springs Clinic • Provide services to up to 100 individuals at a time. • Aim to serve 150-175 each year • Year one goal: Serve 100 indviduals 5 Current Successes • Began enrolling participants at the end of March • As of July 12th: 33 Individuals enrolled • Achieved goal of 80% of individuals being enrolled within 7 days of referral • 16 connected to behavioral health prescriber • One participant housed- 3 pending move ins 6 Expansion Opportunities • LPHA Team Lead • Mental Health Peer Support Specialist • Peer Recovery Coach • Housing Stability Specialist • Funding to house 15 clients for 18 months • Emergency Housing Vouchers 7 Thank you for your time! Annual Internal Review This report covers the time period of 7/1/2020 to 6/30/2021 __Downtown Austin Community Court Advisory Board___ The Board/Commission mission statement (per the City Code) is: The mission of the Downtown Austin Community Court Advisory Board (“Board”), according to article 2-1-130 of the City Code, is to “advise the Downtown Austin Community Court on policy and operational issues and advise the council on the policies and operations of the court.” The purpose of the Downtown Austin Community Court (DACC) is to collaboratively address the quality of all residents in the downtown Austin community through the swift, creative sentencing of public order offenders. The Court seeks to hold people responsible while also offering help to change behavior. 1. Describe the board’s actions supporting their mission during the previous calendar year. Address all elements of the board’s mission statement as provided in the relevant sections of the City Code. During the reporting period (7/1/2020 to 6/30/2021), the Board met (6) times. Due to the Public Health Emergency’s health and safety recommendations, all meetings were held via videoconferencing however, they were posted to and open to the public. Our primary actions during these times were educational. - The Board received regular updates from DACC staff concerning homelessness efforts including the status of operations during COVID-19, and the necessary adjustments needed to address the changing needs of individuals served and DACC’s staff during the pandemic. Updates were provided regarding Rapid Rehousing efforts, virtual hearings, Terrazas temporary relocation, DACC facility updates, Violet Keep Safe Program, emergency shelter redesign efforts, budget changes and development opportunities. - Dianna Grey, Homeless Services Strategy Officer offered updates on the HEAL initiative and City efforts to address homelessness. Annual Review and Work Plan 7/1/2020 to 6/30/2021 Page #2 - Vella Karman, Homeless Services Division Manager presented a summary of Barb Poppe’s Austin Investing for Results Report. - Ramesh Swaminathan, Managing Engineer of Watershed Protection, presented on ordinance changes, implementation, and enforcement strategies surrounding public space management initiatives and homeless encampment strategies. - The Office of Real Estate presented on efforts to assist the DACC find a new location. - Lastly, the Board discussed at length during meetings the strengths and challenges of the Coordinated Entry System and the barriers impacting housing placement in the City of Austin. DOWNTOWN AUSTIN COMMUNITY COURT ADVISORY BOARD RECOMMENDATION 20210312-002A Fiscal Year 2021-2022 Budget March 12, 2021 Date: Subject: Motioned By: Gary Ponder Seconded By: Drew Williamson Recommendations 1. The DACC needs to locate a new facility and temporarily equip case management staff with the ability to work out of a fleet of vehicles and from their homes; 2. Funding for case management fleet vehicles; 3. Sustained funding for six grant funded COVID-19 case managers; 4. Funds to continue the Violet KeepSafe Program; 5. Funds to continue the Homeless Health and Wellness collaborative with Integral Care and the Downtown Austin Alliance; 6. Funding to augment DACC’s case management capacity by adding 12 positions; and 7. Additional social service dollars to include funding for client rental assistance. Description of Recommendations to Council 1. For more than 7 years, the DACC has operated without adequate space for its operation. The DACC does not have adequate space at its main location. 2. DACC is in need of more case management fleet vehicles and funding to rent vehicles from the Fleet Department until any new fleet vehicles arrive. DACC currently owns five fleet vehicles, however, needs to acquire or rent a total of twelve additional fleet vehicles to support the community-based work provided by the current case management team. 3. These case managers are currently supporting the needs of individuals at the City of Austin’s funded Protective Lodges. 4. The Violet KeepSafe Storage program is a transition storage service that helps people experiencing homelessness keep their possessions safe while navigating their way around the community and out of homelessness. 5. The Homeless Health and Wellness collaborative with Integral Care and the Downtown Austin Alliance expands upon Integral Care’s continuum of services by increasing access to specialty mental health, substance use treatment and primary care for individuals experiencing homelessness. 6. Adding 12 positions will support the needs of 266 individuals experiencing homelessness on DACC’s current waiting list, provide additional triage case management to support walk ins, and one additional triage case manager to support the Terrazas Branch Library staff. 7. Additional social service dollars to include funding for client rental assistance. 1 of 2 Rationale Homelessness has been identified, by City Council, as the top priority for the city strategic plan, and as a strategic outcome indicator in Austin’s strategic direction.
